Material Science

At virtually every stage of product or packaging development, material science is the essential link between physics, chemistry, biology, and mechanical engineering. And Fitch Even lawyers are unsurpassed at developing strategies for protecting unique material science innovations. Whether the technology involves polymers, sealants, ceramics, composites, adhesives, or any one of many other material usages, we ask the right questions of inventors to create a foundation for U.S. Patent and Trademark Office acceptance.

A material science innovation may start out as little more than a formula, a list of materials, or a single property such as improved adhesion. In such instances, our lawyers will engage in detailed analysis and dialogue that brings out the product’s interrelationships and advantages that make for a compelling story on why the invention is unique and patentable. Because we bring such great interdisciplinary strengths to material science (including lawyers experienced in molecular biology, electrical engineering, physics, mechanical engineering, and chemical engineering), we can help a client protect from the simplest to the most complex material applications.

A particularly active area of our material science practice involves assisting clients engaged in the development, protection, and commercialization of nanotechnology advances. Because our broad spectrum of technical strengths includes not only the material science disciplines but also such complex nanotech-related fields as optics, microbiology, and electrical engineering, we understand the intricacies of materials manufactured to nanoscale (approximately 1/100,000 the width of a human hair). Fitch Even has played a role in protecting important nanotechnology advances such as enabling technology for the synthesis of ultra-nanocrystalline diamond film and related applications in industrial seals, chemical electrodes, micro-electrical mechanical systems (MEMS), flat-panel displays, medical devices, cutting tools, and digital circuits. The firm has also handled significant litigation involving an international portfolio of ultra-nanocrystalline diamond film patents, which involved assembling an international panel of experts to address complex issues of patent law, licensing, and economic modeling in numerous countries.

We also regularly conduct investigations into material science technologies and associated IP for providing freedom-to-operate opinions to clients involved in these areas. In recent years, our lawyers have also been called upon to conduct IP due diligence and to negotiate IP agreements for several corporate transactions involving material science technology assets and product lines in the medical device arena.

Fitch Even lawyers have the industry knowledge, legal skills, and technical insight to provide significant value to clients whose mission involves developing advanced materials that enable product improvements and create entire new product categories. We work with our clients as advocates and investigators to protect, enforce, and defend their material science innovations at every stage of the innovation life cycle.
