A particularly active area of our material science practice involves assisting clients engaged in the development, protection, and commercialization of nanotechnology advances. Because our broad spectrum of technical strengths includes not only the material science disciplines but also such complex nanotech-related fields as optics, microbiology, and electrical engineering, we understand the intricacies of materials manufactured to nanoscale (approximately 1/100,000 the width of a human hair). Fitch Even has played a role in protecting important nanotechnology advances such as enabling technology for the synthesis of ultra-nanocrystalline diamond film and related applications in industrial seals, chemical electrodes, micro-electrical mechanical systems (MEMS), flat-panel displays, medical devices, cutting tools, and digital circuits. The firm has also handled significant litigation involving an international portfolio of ultra-nanocrystalline diamond film patents, which involved assembling an international panel of experts to address complex issues of patent law, licensing, and economic modeling in numerous countries.

We also regularly conduct investigations into material science technologies and associated IP for providing freedom-to-operate opinions to clients involved in these areas. In recent years, our lawyers have also been called upon to conduct IP due diligence and to negotiate IP agreements for several corporate transactions involving material science technology assets and product lines in the medical device arena.
