Fitch Even partner David A. Gosse was quoted in the February 10 issue of Bloomberg Law in an article discussing contract clauses about forum selection after a Federal Circuit ruling in Nippon Shinyaku Co v. Sarepta Therapeutics Inc.
In the article, “Forum Selection Clauses No Longer ‘Boilerplate’ for IP Fights,” Dave comments that “Patent owners, I think, will see it as a nice thing to see that the Federal Circuit has weighed in with that sort of endorsement—that you’re allowed to contract away whatever right you might have to go to the PTAB.”
Dave represents clients in district court and PTAB litigation, with deposition and courtroom experience in both venues.
