In the article, “Federal Circuit Warns Against Patent Owner Sandbagging in IPR Claim Construction,” Ken and Alvaro discuss the case of Axonics, Inc. v. Medtronic, Inc., and the Federal Circuit’s ruling that the Patent Trial and Appeal Board must consider an inter partes review petitioner’s arguments raised in their reply brief regarding a claim construction proposed by the patent owner’s response brief.
