IP Alert: Supreme Court Reverses Decisions in Limelight Networks v. Akamai and Nautilus v. Biosig

Today the U.S. Supreme Court reversed decisions of the U.S. Court of Appeals for the Federal Circuit in both Limelight Networks, Inc. v. Akamai Technologies, Inc. and Nautilus Inc. v. Biosig Instruments Inc.

In the Limelight case, the Court, by a 9-0 vote, reversed the August 2012 ruling by a divided Federal Circuit in Akamai’s favor, holding that a party may not establish liability for inducing infringement in the absence of a direct infringer. In the Nautilus case, the Court held that the Federal Circuit’s “insolubly ambiguous” standard for patent claims was not sufficiently specific under 35 U.S.C. 112.
