The U.S. Supreme Court today ruled against Aereo, Inc. in a closely watched case involving an allegation of copyright infringement. In American Broadcasting Cos., Inc. v. Aereo, Inc., a majority of the Court held that Aereo infringed copyrights by providing what the Court characterized as “a technologically complex service that allows them to watch television programs over the Internet at about the same time as the programs are broadcast over the air.” The Court found that Aereo’s streaming of copyrighted television shows was both “public” and a “perform[ance],” thereby triggering liability under the Copyright Act.
