IP Alert: Hague Agreement to Come into Effect

Today the U.S. Patent and Trademark Office (USPTO) announced that it has deposited its instrument of ratification to the Geneva Act of the Hague Agreement Concerning the International Registration of Industrial Designs. More details concerning the Hague Agreement can be found in our earlier IP alert regarding the Patent Law Treaties Implementation Act. Generally, the Geneva Act will allow for U.S. applicants to file a single international design application either with the World Intellectual Property Organization in Geneva, Switzerland, or with the USPTO to obtain protection in multiple jurisdictions.  

The Geneva Act is scheduled to go into effect for the United States on May 13, 2015. The USPTO further announced that it will soon be publishing final rules to implement the provisions of the treaty. These rules are also expected to go into effect on May 13, 2015. Fitch Even attorneys will watch for the publication of the new rules and will provide an analysis in a forthcoming alert.
