IP Alert UPDATE: Supreme Court Rejects Challenge to Google Books Copyright Case

UPDATE: Today the U.S. Supreme Court declined hearing a challenge by the Authors Guild and a number of individual writers who claim that Google's immense online library consisting of millions of scanned books is a violation of copyright law.

The Court denied a petition for a writ of certiorari filed by the Authors Guild, requesting review of the Second Circuit Court of Appeals’ October 2015 decision in Authors Guild v. Google, a copyright infringement case originally filed in 2005. The Authors Guild's position has been that "authors should be compensated when their work is copied for commercial purposes.” The justices' refusal to hear the case leaves in place the Second Circuit’s holding that Google’s conduct constitutes “fair use” and allows the Google Books project to continue without having to pay any royalties or make any further concessions to copyright holders.
