Last Friday, the U.S. Supreme Court agreed to weigh in on Google LLC v. Oracle America, Inc., the long-running copyright dispute involving Oracle’s claims that Google unlawfully used Oracle’s software code in its Android operating system. Google had petitioned the Court following the Federal Circuit’s ruling last year that Google had violated Oracle’s copyright.
The Court will consider the following issues:
1. Whether copyright protection extends to a software interface.
2. Whether, as the jury found, petitioner’s use of a software interface in the context of creating a new computer program constitutes fair use.
